The State of Texas HUB program goals are defined in 34 Texas Administrative Code (TAC) 20.13: 21% HUB participation for all building construction, including general contractors and operative builders contracts. According to Texas Gov’t. Code 2161.252 and Texas Administrative Code 20.4, all contracts with an expected value of $100,000 or more require a HUB Subcontracting Plan.

While each agency and business sets its own minority participation goals, each relies on NCTRCA certification to establish a qualified minority subcontractor. A subcontractor is defined as a person who contracts with a prime contractor to work, to supply commodities or to contribute toward completing work for a governmental agency or business.
For example, the City of Dallas requires a Bid Inclusion and Development Plan for all contracts exceeding $50,000. The M/WBE participation goal for Construction projects is 25% of the contract value. Only NCTRCA certified subcontractors can be counted toward achieving the participation goals.
